Sub: Important Notice for the attention of Cooperatives registered under Jammu and Kashmir Self Reliant Cooperative Act of 1999.

NOTICE

Cooperatives registered under Jammu and Kashmir Self Reliant Cooperative Act of 1999 are cast with a statutory obligation to file the Annual Returns duly certified by the Chartered Accountant and approved by the General Body with the office of the Registrar Cooperative Societies, J&K within 30 days from the date of holding of the General Body meeting. The description of the Returns to be filed is further listed under section 46 of the Act, which inter-alia besides revealing the financial status of the Cooperative have to disclose whether the work being carried or carried has been in accordance with the Principles and Practices of the Cooperative. Non submission of the Returns within the time specified is a cognizable offence as per sub section 3 of section 46 of the Act.

Since the enforcement of the Act more than 1700 Cooperatives in different disciplines and categories have been registered, however, majority of the Cooperatives registered have been found non complainant to the statutory obligation. In the absence of the Annual Returns, it is difficult to anticipate whether the Cooperative registered has commenced its business or otherwise. Additionally in the absence of the required information, it cannot be vouched, Whether the business conducted has been in accordance with the parameters of the Act, Articles of Association and the Cooperative principles and practices.

All such Cooperatives registered upto 31-03-2008 having defaulted in the submission of the Returns till date are advised in their own interest to file the defaulted Returns by or before 31st of Match 2010, failing which it shall be presumed that the Cooperative concerned has not commenced its business and accordingly the further action as provided under section 52 of the Act would be initiated, without any further notice or intimation to the Cooperative concerned.

Settlement of freight claims of Cooperative Marketing Societies/ Central Level Cooperatives on account of transportation of decontrolled fertilizers viz DAP/ MOP/ NPK lifted and distributed by such Institutions during Rabi 2006-07 and Kharief 2007 under authorization issued by this office as per standing Govt. orders.
